"...two police cars roared up beside me and cut me off, like a scene from Starsky and Hutch, and officers told me I was being arrested under the Terrorism Act. The harbour master was waffling on and (saying that), because of September 11, I would be arrested and charged.”

Makes perfect sense to me. Pedestrian on a bike path. Al-Zarqawi probably put her up to it.

The Scotsman: Police Defend Terrorism Arrest

...A Tayside Police spokeswoman said: "A woman was reported to the procurator fiscal in Dundee for breaching Port Authority regulations. The woman was found walking within in a restricted area of Dundee port without authority. She was escorted out of the area and subsequently reported to the procurator fiscal under the Ship and Port Facility Security Regulations 2004 for being in a restricted area without permission and for failing to leave the area when requested to do so by the Port Authority."

She added that the same action would be taken against anyone found to be breaching harbour security.

A spokesman for the Port of Dundee Ltd, which runs the harbour, said they had followed correct security regulations.

"Port of Dundee Ltd has fully complied with the International Ship and Port Facility Security (ISPS) code, implemented in July 2004. This code was introduced with Government backing and is intended to enhance UK port security and guard against acts of terrorism."

He added: "If anyone breaches security measures or is on port property without authorisation then they will face exactly the same action."

She said: “I’ve been walking to work every morning for months and months to keep fit. One day, I was told by a guard on the gate that I couldn’t use the route any more because it was solely a cycle path and he said, if I was caught doing it again, I’d be arrested.
Ex RAF copper? :)

From today's Telegraph concerning the police use of the new terror Bill...

Supporters of the controversial measure, including the Prime Minister, have tried to reassure critics by claiming that the extra powers, which are unprecedented among police forces in the western world, will be needed in only a handful of cases and will be controlled by a senior judge.
Unless that is, you're a dangerous pedestrian.

how can a cyclist not be a threat but a pedistrian probalby some mad Health and safety ruling i.e if you fall in the harbour from a bike thats ok but if you get hit by a cyclist you could sue :( .
she was warned by the guard. as its probably not a public right of way she would have no lawful right of way but trespass is a civil offense unless its a naval harbour when I think they can hang you 8O .
the security guard should have been more jobsworth stupid rules are stupid rules but its hardly a police matter
many years ago did guard on a barracks that had a public footpath running through it and no perimeter fence some bright eyed loon decided the footpath had to be closed as that would make the barracks more secure
spent an entertaining few days running up to dog walkers and trying to get them stop using the footpath :x.
had one clown thought if someone ignored 3 clear warnings he could shoot them

Sounds like the sort of thing that is best addressed with mass trespass (except trespass is not a direct offence up north), anyone got Janet Street Porter's number?

In the article it said:
A spokesman for Forth Ports said: “We will robustly prosecute anyone who breaches these new security measures because they have been introduced by the Government and we are obliged to enforce them.”
Is that the same as, "I was only following orders."?

Hmmm, dangerous times. The BIG question is what happens if you fall off your bike? Do you have a wonder-woman like blur and turn into a terrorist as your nose splatters on the tarmac? In which case the logical answer is for the police to install tilt-switch bombs in all bikes so they kill you at the moment of transformation.

Interesting aside - Trespass doesn't exist in Scotland. It's an English law.

Makes these folk even bigger cnuts.

Trespass is not a Criminal Offence even in England! It is a Civil Offence..... You cannot be arrested for Trespass on its own.

In this case they used the Terrorism Act quoting the International Ship and Port Facility Security (ISPS) Code which is not in itself UK law.
