Erm, not really. Assuming he admitted to stabbing the bloke, they arrested him. Ergo, they arrested the right man.

Hand the outrage bus keys back into the MT Office until later.

Can someone find a link to th previous threads? Much easier to read that rather than going again through the dark hints that the stabber was a drug dealer or criminal or other kind; the abuse hurled at Plod; Plod calling Western a **** even before he posts anything; the claims that arresting people on suspicion of murder is doing them a favour, and so on.

And if he acted in genuine self defence he'll be released without charge in a few days just like the other two were.

One. More. Time: In a situation where one person has killed another, police will arrest the one still breathing. This gives Plod time to investigate whether it was murder, manslaughter or reasonable force. This is Plod SOP, and for very good legal reasons.

Someone tell the Duty Driver to park the Outrage Bus until further notice.

Undoubtedly. Getting a reply to the caution might prove a tad more difficult though.
Exercising the Right to Silence, isn't it? Dixon of Dock Green would have had that corpse doing a five stretch for burglary and rapscallionism before rigor mortis had worn off.

And it would cut the risk of death in custody to nothing, whilst reducing claims for unfair conviction at the same time. Win win, really.

Well of course they arrested him, he was burgled, the intruder has a big gollock sticking out of him and the guy says its his, what else could the Bill do "Oh, so YOU stabbed him in the act of intruding, Ah well in that case sir we,ll toddle off, mind how you go" is that what is wanted?, due process is what will happen now.......wont it???

Is it really for the police 'n CPS to decide or should that be up to a jury?

If your bread knife is sticking out of someone's rib cage, and you admit to putting it there, that's actus reas. No amount of hard evidence can prove or disprove mens rea, hence juries.

It was only yesterday my missus was discussing buying a house in Bramhall. I shall remember to pack extra kitchen knives!
