If they are going to do that, then it should only apply to cases held in a peaceful area, where they can gather 12 people as a jury/huge tribunal. Otherwise the current rules should apply.
All CMs are held in peaceful areas now - not to say that they won't be in future, and as you quite rightly say getting 12 Offrs/WOs in one place in wartime would prove difficult.
The fact remains the MCJS has survived numerous challenges to its process by various parties and still remains extant. It is acknowledged and recognised as legitimate as are its convictions. It has a number of safeguards within it, and its important to note that civilians take centre stage in a number of areas - JAs and the head of the SPA - to preserve a level of independance from the Military.
