Help with over turning discharge

HI folks not sure if you can help in 72 I signed up went to Woolwich did half my training bought my self out half way through training for twenty pounds as it wasn't for me only joined through peer pressure as had four brothers in forces was out about eight months no works etc joined back up gave it another try remember I had only done half of my training so like I said joined up sent to Woolwich again I was put in the req billit no matter who I said it to that my training hadn't finished no one listened any way I was at Woolwich for about five days shipped to Germany then within maybe another few days I was on the streets of Ireland no tin city no training for Ireland etc any way the regt I joined my brothers used to serve in they couldn't believe I was there untrained any way I managed to do what I could allways taile Charlie lol on patrol you can't imagine what was going through this eighteen year olds head one day we used to go to black Mountain I was in the snatch motor ready to go a officer a bdr and a Sgt plus driver jumped we set of with me through the hatch facing forward of we go but the idiot officer set of with out back up vehicle so hitting a certain area we was ambushed I was up in hatch no one watching my back shots fired dropped down they thought I had copped one in the head the Sgt and bdr were shot plus a woman officer panicky shouting have we to stop to his sgt but the Sgt was shot any way folks they evacuated to hospital I was sent to black Mountain you can't imaging the state of mind I was in remember this was a guy with no training we came back to Germany but it was to late for me p.t.s.d had set in drinking awol etc no help from any one I was left to my own devices was glass housed a few times they was ordered to break me and believe me the stuff they did to me was unbelievable it was mental and physical torture any way I was out as a undesirable the officer was court martial is my understanding I was informed he and the N.C.Os had lied at court martial there is so much to this story to be told it was so wrong what happened it was a conspiracy I feel to get rid of me so I was the only one who knew what happened now many years on and having to carry this burden of you can call it a white feather of shame I was fineally diagnosed with p.t.s.d in 2013 given a war pension that's it when they broke me I was called in front of c.o he just said do you want to leave I said yes he just said ok discharged I was wondering if any of you know of a way I can get this ruling overy turned as really I was suffering from undiagnosed p.t.s.d that they hadn't picked up on I ended up with alcoholism /mental institutes/prison been sober twelve years now this has been with me for over fifty years now was just wondering if it could be over turned thank you for your time reg

Really rubish at doing paragraphs etc my spelling etc not the best in the world sorry I have been told this so many times just don't know how to do it I do hope you can manage to read it some how thank you

From what you say, you were asked if you wanted to leave the army. You effectively resigned having been given the opportunity to do so.

It seems unlikely that you will reverse that. The Army was a different employer entity back in your day. Under the prevailing 'terms and conditions' there would have been solid grounds to dismiss (discharge) you whether medically (your mental condition, incurable alcoholism etc rendering you unfit to soldier on) or for your very poor and worsening disciplinary record.

Your COC probably felt it was neither in the interests of the service nor in your best interests to go through the formal process of discharging you when all you wanted was to simply just leave.

That's my take but as always, you should really seek more qualified advice than you are likely/going to get here.

Out of interest, what does/did your red book give as the reason for discharge?

Not sure where to start with the paragraphs, some basic punctuation may have helped, commas and full stops perhaps?
I got as far as the ambush and gave up. Not only does this not belong in this thread it is making my eyes bleed.

Seems to be a lot of disbelief. Military records show on signing on second time recruitment office put down regular soldier that is why I was by passed at Woolwich.

Apart from the poor punctuation which makes your original post very difficult to read, it sounds extremely odd that any rejoiner would be posted out of any depot to any unit without a cursory check on whether he/she was qualified and to what level. It also sounds odd that you were deployed to NI as a newly joined soldier with no training, although stranger things have supposedly happened.

The recruitment office were probably correct, irrespective of how long you'd served or whether you'd completed basic training, you were in fact an ex regular soldier. I believe it should have been down to your Corps/Regimental Manning & Records office to complete a check on what training you had undertaken, whether that check was initiated by the recruiters or depot is a question someone else may know.

Someone has already pointed out that you were asked if you wanted to be discharged and you confirmed that you did. Nothing you say or do now will ever change that as it was your decision, your CO gave you the option and you took it.

You have a War Pension and you are now sober, both good things, just concentrate on keeping well and supporting others. If you need more help or support, SSAFA and other military charities may be able to help.

I was at Woolwich for about five days then shipped to Germany; after another few days I was on the streets of Ireland: no tin city, no training for Ireland etc. Any way the regt I joined my brothers used to serve in, they couldn't believe I was there untrained. I managed to do what I could allways taile Charlie lol on patrol. You can't imagine what was going through this eighteen year old's head.

One day we went to black Mountain. I was in the snatch motor ready to go. An officer, a bdr and a Sgt plus driver jumped in. We set off with me through the hatch facing forward. Off we go but the idiot officer set off with out back up vehicle, so hitting a certain area we was ambushed. I was up in hatch with no one watching my back. Shots were fired, I dropped down, they thought I had copped one in the hea. The Sgt and bdr were shot. Plus, a woman officer panicky shouting have we to stop to his sgt but the Sgt was shot.

That's when they broke me; I was called in front of the CO, he just said, 'do you want to leave', I said, 'yes'. He just said, ' ok discharged'.

I was wondering if any of you know of a way I can get this ruling over turned as really I was suffering from diagnosed PTSD that they hadn't picked up on. I ended up with alcoholism /mental institutes/prison. I've been sober twelve years now, but this has been with me for over fifty years.

I was just wondering if it could be over turned? thank you for your time reg

Assuming it is, your options could include:

1. Contact the RBL
2. Write to the Royal Artillery Association.
3. Write to your MP.
4. Contact APC at Glasgow and ask for copies of all your Service records - (Subject Access Request)
5. Engage a solicitor who specialises in employment matters.
6. Suck it up!
7. A mixture of any of the above.

Presumably your four brothers can add credibility to your case?
But, before you do write to anyone, please, FFS, get someone to proof read your efforts.
