E2A it is 100g TOTAL of all Schedule 1 chemicals and must still be declared to the OPCW
I suppose that it is just your private opinion. Or you may quote the treaty to back your point.

It’s not in the schedule as Russia hasn’t declared it hence the OPCW request to identify “...new types of nerve agents.”

Really? Ordinary salt NaCl or water H_2O can cause death. It was not used to kill people by Russians, so it was nor 'poison' nor 'toxin', neigher 'chemical weapon'. Producing any amounts for research goals is allowed by the treaty.
In fact, it was not even proven, that ethyl N-[(1E)-1-(diethylamino)ethylidene]-phosphoramidofluoridate can cause death when it is used in little amounts. Do you know it's LD50? No.

Which part of the CWC is that mentioned in? Or is that a huge distraction from the point that Russia hasn’t declared all CW in accordance with their obligations.

And CO2, if used as a method of warfare could be classified as a chemical weapon I.E. if you flooded a bunker complex with CO2 to take advantage of it's toxic properties to kill those inside or drive them out!

Oh and here is the main relevant section of the CWC for you:
"A. General Provisions

1. A State Party shall not produce, acquire, retain or use Schedule 1 chemicals outside the territories of States Parties and shall not transfer such chemicals outside its territory except to another State Party.

2. A State Party shall not produce, acquire, retain, transfer or use Schedule 1 chemicals unless:

(a) The chemicals are applied to research, medical, pharmaceutical or protective purposes; and

(b) The types and quantities of chemicals are strictly limited to those which can be justified for such purposes; and

(c) The aggregate amount of such chemicals at any given time for such purposes is equal to or less than 1 tonne; and

(d) The aggregate amount for such purposes acquired by a State Party in any year through production, withdrawal from chemical weapons stocks and transfer is equal to or less than 1 tonne".

Each State Party is obliged to have an aggregate amount of less than 1 tonne and is obliged to prove that. Facilities that produce less than 100g/a are not subject to the verification regime themselves but their production comes under the State Party's total and must be declared to the National Authority!
