I have been seen off for at least 11k plus this month rent, i have not long left and i need this like a hole in the head. Am i the muppet for not transferring the money out? I asked the question to Richard a couple of years back about the accounts and he said they were ring fenced, now i am not so shaw. We do not know yet why they went bang this will help in understanding how to go forward, if it was fraud then i fear we are out of luck.
I'm hoping that something I've found in my records is the news everyone wants to hear.
Firstly, I reviewed my mortgage statements and found all the payments in to my mortgage were made by Direct Debit. I thought that if the money had been paid from Blueforces own accounts, the payments would have been by standing order. I therefore assumed (but not 100% sure) that a direct debit would have to come from an individual personal account.
Next I found a critical letter from my mortgage company. In autumn 2009 I approached my mortgage company to make a large overpayment, which I was going to make by Debit Card payment from my normal Barclays account. First Active misunderstood what I had asked them to do and sent a letter confirming that this overpayment would be taken from my normal direct debit account. I quote "As requested, we've arranged to take an extra direct debit payment of £XXXX from your Nat West Bank Plc account number XXXXXXXX on ...date...". So, this means that our PMAs are actual bank accounts with Nat West. So this is probably why nobody has defaulted in their mortgage (and other) payments so far, despite Blueforces being in dire straights. Now I have the account number, my wife and I will be marching down to the nearest Nat West branch tomorrow (if I can squeeze the time out of work) with every piece of ID we can muster to see if we can take ownership of this account. I'll keep you all updated as to where I get with this.
I'm also hoping that, as long as there is a reasonable reserve built up in peoples' PMAs, the folks who are currently stuck in a FOB in Afghanistan will have some breathing space to get things sorted (ie the direct debit from their PMA will keep paying the mortgage as long as the PMA account remains in credit). It is this fundamental fact about the PMAs that I believe the Army should appoint a lawyer to confirm with the Administrators. I'm sure between Freedom of Information and Data Protection laws, the Administrators can be made to forward details of the PMA account numbers to Blueforces clients post haste.
I'm sure we will have lost money, not least the scheme contribution which came out of my account on 1 Feb, 2 days before BFPL sent out the liquidation letters. Because that money is a standing order to BFPL, rather than directly into the PMA, I'm pretty sure that'll have disappeared. Any recently paid rent that hasn't been moved into the PMA is probably lost also, along with any deposit the Tenant may have paid BFPL. The deposit is a pain because the rental contract is between the Tenant and us Landlords, so we are ultimately liable for returning the deposit even if BFPL have 'lost' it in going bust. So I agree we almost certainly been seen off; it's just how far.

You may be ok on the deposit side, at least. Since 2007 tenants' deposits have had to be placed in an escrow account which is not directly accessible by the tenant/agent/landlord unless both parties to the tenancy agree.
Details of the legal requirement on landlords and agents are here.
I'll keep my fingers crossed that this bit, at least, doesn't bite you all.
Just so you have an idea of the numbers I am throwing my hat into the ring. Like all the rest of you I have been waiting for my tax figures from BF and assured that apart from the delay in the posting out following an audit, everything else was fine. They went on to take the standard allotment from my Bank on 2nd Feb, DD now cancelled, and apart from the recent letter, nothing.
I am fortunate to know who they sub contract the managemant of the property through and will be arranging for rent and costs to be dealt with by them.
The tax office have said that even if you file your return by may, as long as it is a negative then there will not be a fine, that is what they have said, please do check for yourselves. As for the managment account money, I have not had any contact from either the proposed insolvency company or new letting company.
It looks like I was premature with my hope from finding an account number with Nat West. I have subsequently found an invoice from Blueforces which was with the pack of information they sent to me for my tax return 05-06. At the bottom of the invoice is the Blueforces company account number and sort code for payments to be made to. It is the same account number that was paying my mortgage direct debit. I'm still confused how I was able to change my mortgage direct debit payments (on a number of occasions) without having to speak to Blueforces (for instance, I could have told the mortgage company to settle my entire mortgage balance on the next direct debit).
It's at this point that I think we need legal advice to unpick the banking/accounting processes used. My first port of call as a private individual will be the Citizens' Advice Bureau. I will still push the issue up to my HQ tomorrow morning, as it would seem sensible that the MOD task one of it's own lawyers to investigate the issues and promulgate the findings to everybody.
We have been well and truley stiffed end of story folks. These f**kers have ruined any trust we put in society. If there is a god of LAW out there please make yourself Known so that we are not the ones that loose out. Somebody needs to be accountable as we are told through our military careers the army promoted these people to put our trust in to manage our properties then they should foot their debt. People the first thing to do is stop all payments to the Scum then to make sure your mortgage is paid after that make sure that your buildinding insurance is covered along with the tennants liablity insurance, try get hold of your tennants and stop them paying into the abyss. Fianally beware of who you trust out there and make sure you dont sign up to any W**KERS that just wanna take your cash.
I've just joined Arrse specifically to be able to tell you about my circumstances.
In a nutshell the same as all of you.
I'm in Afghan right now on a 7 1/2 month tour - so this is going to be an utter nightmare to try and sort.
My accountant was compiling my 2010/2011 tax return. We received emails from BF saying they had a problem with their account summaries and were working through them. Also received a second email saying not to call them because answering the phone calls slowed down their ability to vet and release our Statements for the tax year! My accountant only emailed them in mid Jan! Nothing else heard from them since until my wife got 'the' letter on Friday morning - also dated 12 Nov 10 (no posting date as part of the post franking mark on the envelope so cannot be sure when it was posted therefore no indication of when it was written).
I have a few thousand in my PMA. BF have all the details of my tenant, the contracts between landlord and tenant, etc. The whole lot.
I'm already beginning to think that I'll be spending both sets of my R&R and my POL looking for Mr Smith in order to extract some answers face-to-face.
I'm gutted. Truly gutted, let down and p1$$ed off.
Really didn't need this on top of everything I'm going through out here.
I'll be reading any and all posts that those of you are kind enough to publish here on this issue. Your knowledge and findings will aid me immensely. I'm off to find one of the Lawyers on Bastion 1 tomorrow and then go from there.
Hi I really need some info on this. We live in Germany and only found out about this by email from the letting agent offering their services. We have a couple of thousand in our PMA with Blue Forces and have no idea whether our mortgage has been paid etc. I wouldn't mind but my husband only spoke to them just over a week ago and they assured us everything was fine. We haven't been able to complete our tax return or anything. Tomorrow I'm going to start the gruelling task of phoning around the mortgage and life assurance companies. Not sure where to start really. It was only a few days ago that more money went into that account. My husband has just gone away aswell....really not needing this right now. If someone could be of assistance I would be grateful. I have spoken with my dad who lives in Colchester and he's going to see if he can find anything out.
