    If anybody is charged, then as stated the court can award compensation. The police should provide with a form to fill in which gets sent with the case papers(then lost by the CPS). It's then the courts desicion as to wether it's award it or not.

    You don't say if your going through the courts or not.

    If youa re going through the courts then JP's would (on a guilty verdict) determine compensation. From what you say, we would be hard pushed not to award it. But it makes our lives easier if you can say exactly what compensation you would wish and reasons why.

    Like I said, as a temp I didn't get sick leave, so all I'd really look to be getting back is my loss of earnings for a week and maybe enough to replace my ruined clothes.

    Since my original post I have received the forms from the court system regarding compo.

    I was awarded compo after being left with permanent facial scar. I didn't ask for compensation, the court just awarded it.

    I'm pretty sure it is only paid out on the level of injuries you received rather than any loss of earnings per se.

    I think it can be for either/both.....the form has a section to detail any items damaged/lost through the incident, as well as further sections for loss of earnings and any medical complications.

    I shall fill it all in and send it off, and wait and see when it eventually goes to trial!

    The Criminal Injuries Compensation Authority is a government organisation that can pay money (compensation) to people who have been physically or mentally injured because they were the blameless victim of a violent crime.

    An information booklet on the awards payout can be found here.

    The Scheme is made by the Secretary of State under the Criminal Injuries Compensation Act 1995. Applications received on or after 3 November 2008 for the payment of compensation to, or in respect of, persons who have sustained criminal injury will be considered under this Scheme. Details are contained here.

    Quick update guys, thanks for all your input!

    The court awarded me no compensation, presumably as the guy had no assets.

    He was sentenced to an indeterminate sentence to serve a minimum of 5 years.

    Application sent off to CICA, waiting for them now!

    I've just spent the past year corresponding mass complaints to the CICA to actually do something with my claim. I was attacked 2 years ago, but only put my claim application in about a year ago. Only just received my payout after further requesting the involvement of my local MP. Although they took a while, and I had to be persistent about it, the payout was still accurately reviewed and the rewarded sum of money was rather generous concerning the circumstances (£320).

    Just a few tips though. Phone them once a month and request an update regarding your case reference. This is where they stick a sidenote onto your casefile stating you're being persistent about it. Thats what they did with mine.

    Also, try not to exaggerate anything. I had moderate scarring from my injury but claimed it was far worse than it actually was. They soon sent me mail requesting photographic evidence.

    To be honest, its not entirely their fault they're shite. They're job is to obtain evidence from the third-parties involved to confirm your claim, then use it to make an informed decision on the sum to reward. Statements from police, surgical procedures from whichever surgeon in whichever hospital, court specifics etc etc. All takes a while. Be patient and persistent.

    I used to work as a nurse in an environment where violence was common. I was also a Unison rep. I recall that I was frequently raising awareness of CICA. I'm afraid I don't remember much about the procedure, but, if you are a member of a Trade Union, they do have vast amount of knowledge and can be very helpful. It wouldn't hurt to give them a call.
