im absolutely stuck with what to do or who can help me .. ive spoken to david marsh at forces pension society and he is gona have a look at all my paperwork etc but even he thinks i should have had an immediate pension etc..<br />

right here goes so hope someone can understand this .. ive been awarded a 20% war pension which i am currently appealing so will leave that alone for now.<br />

but what i am wondering the other pension i have is a preserved pension which i got when i left but heres where im stuck .. <br />

do i need to contact the pensions department because now i have been awarded a war pension does this preserved pension change because the army have now accepted it was there fault and how do ik go about doing this . because i have been given all different kinds of advice about this .. some people saying that i should now receive an immediate pension instead of a preserved pension ?? <br />

I wanted to offer some advice to those of you who may have found yourselves in a similar position to me.<br />
<br />
I left the Army in Jan 2007 (having completed 12 years under AFPS 75).  I then rejoined in Jul 2007.  Soon after rejoining I requested a pension forecast from SPVA.<br />
<br />
Let me quote directly from that forecast:<br />
<br />
&quot;The following forecast is based on an aggregation of your two separate periods of Service in the Armed Forces, twelve years in the AFPS 75 Pension Scheme and six years 67 days in the AFPS 05 scheme.  It is based on your current salary of ........<br />
<br />
Forecasted benefits as at ..Oct 2013:<br />
<br />
An immediately payable Early Departure Point (EDP) payment of £.........<br />
An immediately payable tax free lump sum of £........<br />
<br />
The point here is that in 2008 I received a forecast for EDP benefits.<br />
<br />
<br />
This came as a bit of shock to me, because I had not realised that I was automatically part of the AFPS 05 scheme on rejoining.  I sent a letter to the SPVA in a vain attempt to try and stay on the AFPS 75 scheme, but was told that unless you rejoin within 30 days of getting out you will be automatically on the AFPS 05 scheme.  But the point is that I have a document which clearly states and accepts the amalgamtion <br />
<br />
So I was left with 2 options:<br />
<br />
1.  Keep the 12 years accrued on the AFPS 75 as a preserved pension payable at aged 60, and have 2 separate pensions.<br />
<br />
2.  Amalgamate this previous service with current AFPS 05 scheme.<br />
<br />
I went for option 2, incidentally, these options were given to me in a letter by SPVA.<br />
<br />
I recently requested a pension forecast (March 2013), which stated, again, that I will qualify for EDP payments.  So all was well.  I then sent this forecast to the Forces Pension Society, and it was only at this stage that I became aware of the 'bombshell'.<br />
<br />
There is a term which has 'crept' into the latest AFPS 05 Scheme Pension Booklet (issued Aug 2012) which states 'Relevant Service'.  I think it is important to point out that in the version of 2007 there is only reference to 'Reckonable Service'.<br />
<br />
It means that all previous service in the AFPS 75 is not 'relevant' for the EDP Scheme.  This has been experienced by those who have been made redundant, but not, I believe, to those who are still serving.<br />
<br />
As it stands I have an EED of Aug 2019, if I stay in I will have completed 24 years service and will not receive anything until the age of 65 - that age will probably increase.<br />
<br />
My understanding is that the EDP scheme is seperate from the AFPS 05 scheme and is guided by a Statutory Instrument No 437.<br />
<br />
I am sure that some responses will be 'well you should not have got out then should you' and I agree whole heartedly, however I, along with other serving personnel have definitely been misled.  SPVA are claiming that it was an error, but to simply say we will send you out another forecast is totally unacceptable. <br />

The SUPA ceased on 04 Apr 13 and I had to apply via CM Ops to DM(A) for authorisation to receive SUPA beyond the 6 month period, I am still awaiting this authorisation, but have been thinking, would this second period of SUPA have an effect on my pension abatement?<!-- google_ad_section_end --></div>

i was medically discharged with my knees july last year and was awarded a 20% pension. i then appealled this as i felt it was no where near what i deserved as i cannot work anymore because of this and a few other problems also.. my appealed failed and i dont understand why and they never gave me a reason either. what are the next steps to this can i now appeal the decision again as im not happy one bit.. been trying to get a solicitor who can help me with this and because i am in central scotland there are none in this area all who deal with this type of thing are in england. rbl have helped me but i feel i need more help from other sources .<br />

is there any way i can acces this money in any other way or a way around it so i can restart my life with a reasonable some of money etc like change my award into one lump sum or something. <br />
i am now homeless and live on my mates sofas and feel like there is no way back from this <br />

the army have left me with absolutely nothing except a measly £35 a week to get by on.<br />
and i used m lump sum to pay off debts so now im stuck with nothing . cant get a job , dont have any money and a few personal problems also..<br />

In short - I married my ex late 90's (whilst serving), and got the Decree Absolute through 22 months later.<br />
<br />
Still serving, and re-married 2009.<br />
<br />
Now - when it comes to my IP, monthly payments, eventually reaching 55 (hopeful) etc - what is she entitled to, if anything?<br />
<br />
Do I have to give her half of 2/37ths of my lump sum?  Does she get half of 2/37ths of my monthly pension from my 22 year point onwards?<br />
<br />
<br />
Basically, when I leave in a few years I want to invest my money - what I don't wanna do is a few months / years down the line realise some of that should have gone to her (even though she doesn't deserve a penny) and end up in a world of shit.<br />

I am 29 now and I am in the process of joining up again.<br />
Anyone any idea how my pension would work? As far as I am aware FTRS commitment goes toward your army pension, so would that mean I would only have to serve like 12 years to reach my 22?? <br />
