    Yes, it's happened to me far too much lately & I've lost the best part of £500! But how exactly do you refuse to pay? They have your motor! Refuse to pay & it goes to a pound & you have to pay even more to get it released. Apparently it's also a criminal offence to remove the clamp yourself.

    There's not much one can do but pay up in that situation.

    It's not a criminal offence to remove the clamp. It's criminal damage if you break it. I'm not sure how you go on if the Police have fitted it though, and you might still have to pay a parking fine, but not an extortionate clamp release fee.
    Let down your tyre, drive the car out of the clamp (carefully) and fit your spare. Not all clamps allow this of course, but a lot do. Leave the clamp behind ...or chuck it in the canal
    I used to carry a De-Walt.. 18V disc cutter, removed two clamps in my time by cutting the padlocks, took those with me left the clamps. Recieved letters wanting the money and threats of legal action for criminal damage, I wrote back saying go ahead see you in court, never heard from them again. Oh don't do this with police clamps, then you are heading for trouble...
    I did have this option but decided to pay up anyway, if I had cut it then knowing my luck they would have taken me to court. As a ‘first jobber’ a court case would ruin me financially as well as professionally.

    As for this bouncers & fines business, my opinion of them is even less than the clampers. The last time I had a run in with those overstated gorillas I was obliged to spend a few hours at Her Majesty’s leisure.

    Yeah, what he said. This is truly frightening. Some bouncers are still (despite the SIA regulations) not a lot more than thugs and posers.

    This is unacceptable, and has been since it was introduced in 2001.

    That said, the average gorrila is supposed to be written out of the equation in that, "The powers are granted by chief constables under the Police Reform Act 2001 to organisations that contribute towards community safety. They must undergo extensive vetting and training and wear a badge and uniform approved by the chief constable."

    As to not being able to refuse the fixed penalty ticket - I thought that you always had the ability to take any fixed penalty matter to court.

    I think you can refuse the on the spot fine and have your day in court. This will be automatic for people with a criminal record, as they will be referred to the Police. Cue the PNC check by security staff. Talk about an abuse of the system.
    People without a criminal record will also have the right to a court hearing, but how many of them will be informed of this at the time?
    I reckon this will be abused and the security staff will 'absentmindedly' neglect to mention this and people will just pay up.
    Unless they're planning on something like the Police have to say when they arrest someone "You are under arrest for xxxx you have the right to remain silent etc etc..."
    Somehow I doubt it and if they did then I doubt it would be adhered to by security staff.
    Something else... If you do opt for the court case, will you be arrested, DNA swabbed and fingerprinted? It's only an argument/'kick off about your rights' away... and what if you refuse to give your details? It's not as if these people have any power under the law do they? Or have things got even worse than that?
